Return & Exchange Policy

Refunds may only be made where a product does not work correctly and the telecom company providing the service is unable to correct the fault. In this case Customer have the right to cancel an order up to 7 working days after your purchase. If however you chose to use your phone card you lose this right. Accessing the PIN number constitutes use of your card and we cannot cancel your order in this situation. We reserve the right to provide you with a replacement and to charge you for any calls prior to the fault developing.

Terms and Conditions - Legal Agreement

This legal document serves as an agreement between you (Customer) and Speakling. Please read it carefully before placing an order and submitting your personal details.

1. Acknowledgment And Acceptance of Terms

The Service is provided to the Customer under the terms and conditions of this document and any operating rules or policies that may be published by Speakling. This document supersedes all prior agreements between the parties regarding the subject matter contained herein. By completing the order and/or payment forms and clicking the "Submit" or "Confirm" buttons, you are indicating your agreement to be bound by all of the terms and conditions of this document.

2. Description of Service

Speakling is reseller of a large variety of International Calling Cards & Top-up Vouchers which our customers can use to call all around the world. Most of these products are already available in the market and you can easily find them at your local news agent or off licence. Speakling however gaurantees to provide you with the best of prices & latest products round the year.

Unless there is a special arrangement, Speakling will only send you the purchased phone cards / Top-ups in the form of PIN Number(s) to your Speakling account or via email / SMS. Please note that although we at Speakling strive hard to provide you with the best of products out in the market, we do not have any control over their quality. However to weed out poor quality products we have established the user rating system/ user blogs and forums which can help you to find a product which best suits your requirement.

3. Order Fulfilment And Cancellation

Order acceptance and the completion of the contract between the Customer and Speakling will take place on the release of the PIN(s) ordered unless we have notified you that we do not accept your order or you have cancelled it. Non-acceptance of an order may be a result of one of the following:

• The product you ordered being unavailable from stock
• Our inability to obtain authorisation for your payment
• The identification of a pricing or product description error
• You not meeting the eligibility to the criteria set out in this document

Before a PIN is released, the Customer can cancel an order placed by not making a payment or by canceling a payment at his/her own expense.

4. Services Modifications

Speakling reserves the right to modify or discontinue any or all of the Services/Products with or without any prior notice to the Customer. Speakling shall not be liable to the Customer or any third party should Speakling exercise its right to modify or discontinue the Service.

To improve the quality of our services, Speakling may change any terms and conditions of Service. The Customer's continued use of the Service constitutes an affirmative:

• Acknowledgment by the Customer of this document and its modifications; and
• Agreement by the Customer to abide and be bound by this document and its modifications.

5. Disclaimer of Warranties

The Customer expressly agrees that use of the Service is at the Customer's sole risk. The Service is provided on an "as is" and "as available" basis. Speakling makes no warranty that the Service will meet your requirements, or that the Service will be uninterrupted, timely, secure, or error free; nor does Speakling makes any warranty as to the results that may be obtained from the use of the product or as to the accuracy or reliability of any information obtained through the product.

6. Limitation of Liability

Speakling shall not be liable under any circumstances for any indirect, incidental, special or consequential damages beyond the contemplation of parties, including but not limited to loss of profits or income, arising directly or indirectly from any action or failure resulting from using the prepaid phone cards bought from Speakling and shall not be held liable for any surcharges which may be charged by hostels, hotels, or any accommodation providers for use of their phone services. Calls from mobile phones may be subject to a charge from your mobile carrier. Furthermore, Speakling shall not be liable for any direct, indirect, incidental, special or consequential damages.

7. Customer Conduct

The Customer is solely responsible for the contents of his or her transmissions through the product. The Customer's use of the product is subject to all applicable local, regional, national and international laws and regulations. The Customer agrees:

• To comply with UK law regarding the transmission of technical data exported from the United Kingdom through the product; not to use the product for illegal purposes; not to interfere or disrupt networks connected to the product; and
• To comply with all regulations, policies and procedures of networks connected to the product. Customer agrees not to transmit through the product any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature.

The Customer also agrees not to transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable local, country, national or international law or regulation.

8. Re-Distribution, Re-Sale of the Products

The Customer reserves to right of any re-distribution or re-sale of the product(s) already purchased. Speakling however will not be responsible for any product(s) which were not sold directly from its website to its Customers.

9. Participation In Promotions of Advertisers

The Customer may enter into correspondence with or participate in promotions of the Advertisers showing their products on our website. Any such correspondence or promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such correspondence or promotions, are solely between the corresponding Customer and the Advertiser. Speakling assumes no liability, obligation or responsibility for any part of any such correspondence or promotion.

10. Propietary Rights to Content

The Customer acknowledges that content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in either sponsor advertisements or email-distributed, commercially produced information presented to the Customer by Speakling or Speakling's Advertisers, is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws; therefore, the Customer is only permitted to use this Content as expressly authorised by the Service or the Advertiser. The Customer may not copy, reproduce, distribute, or create derivative works from this Content without expressly being authorised to do so by the Service or the Advertiser.

11. Termination

Either the Customer or Speakling may terminate the Service with or without cause at any time and with immediate effect. The Customer's Termination shall be accompanied by a written notice to Speakling or by not using his or her account for more than a period of time deemed necessary to keep the account active. Speakling shall not be liable to the Customer or any third party for termination of Service. Should the Customer object to any terms and conditions of this document or any subsequent modifications thereto or become dissatisfied with the Service in any way, the Customer's only recourse is to immediately:

• Discontinue the use of the Service; terminate subscription; and
• Notify Speakling of termination.

Upon termination of the Service, the Customer's right to use the Service immediately ceases.

Speakling retains the right, at its sole discretion, to determine whether or not the Customer's conduct is consistent with this document and may terminate the Service if a the Customer's conduct is found to be inconsistent

12. Data Protection

1) We do not send random marketing emails to personal email address
2) Our business system conforms to the requirements of the Data Protection Act 1998 (UK)
3) We do not use cookies on our website to track your viewing habits
4) We do not store any Credit Card information in our databases
5) All transactions are made in real time to protect ourcustomers from any fraud or ID theft attempts
